The tenancy of Te Rauhi Pareira Murray Rangikotua at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 4pm on Monday 14 April 2025.

Reasons

Both parties attended the hearing which was conducted remotely.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

The tenancy commenced on 22 April 2024 for a fixed term to end on 21 April 2025.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to pay the weekly rent of $450.00.

The landlord served a 14-day notice on the tenant on 19 December 2024 and the tenant did not remedy the breach within the required period.

From that date the rent was paid spasmodically with rent arrears as of 24 March 2025 totalling $2960.00. Over the course of the 49-week tenancy rent was not paid on the due date on 14 occasions.

On 24 March $470.00 was paid and on 25 March 2025 2 payments totalling $3108.57 were made bringing the tenant into credit by $148.57. The next rent payment was due on 31 March 2025 and has not been paid. As of 4 April 2025 the tenant was in arrears by $172.86.

The tenant failed to attend a scheduled mediation on 7 February 2025 and the Tenancy Tribunal conducted the current hearing on 3 April 2025.

At the hearing the Tribunal questioned Mr Rangikotua as to whether it was possible for him to set up a redirection from his wages which he said was possible. The Tribunal said it would delay making any decision regarding the landlord’s application for a week and that as soon as he had arranged the redirection, he should provide proof of that to the landlord which they would forward to the Tribunal. A decision would then be issued by the Tribunal.

On 4 April 205 the tenant provided a screen shot of his employer banking details which show ‘[The landlord/s] $470.00”. The landlord asked the tenant for details of the when the next payment was due, the frequency of those payments and duration of the redirection. The tenant advised the landlord that this information could not be provided.

Having considered all the above factors I find it would be inequitable to refuse to terminate the tenancy.

Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
