The tenancy of [The tenant/s] at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 6.00pm on Sunday 4 May 2025.
The tenants must pay the landlord $2,677.00 from the bond, calculated as shown in the table below.

Reasons

Both parties attended the hearing.
There are three tenants in this matter: a. One of the tenant’s attended the hearing b. One of the tenants had a representative attend on his behalf by consent of the parties. c. One of the tenants did not attend the hearing. This tenant was telephoned on the phone number provided but the phone call went unanswered. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in his absence.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears, refund of the bond and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. 1
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenants have breached their obligations by failing to pay rent as and when it is due and payable.
The landlord served a 14-day notice on the tenant on 7 January 2025 and the tenant did not remedy the breach within the required period.
The tenant’s that attended the hearing consented to the tenancy terminating. The tenant that did not attend the hearing has given the other tenant’s notice he was vacating the premises, and he has done so. Rent arrears
