Both parties attended the hearing, conducted via teleconference. [Tenant] confirmed he was representing all four tenants.
The landlord sought rent arrears and water rates. The tenant accepted both amounts as claimed and subsequently ordered. He also gave 21 days verbal notice to terminate. He understands this must be confirmed in writing to the landlord.
Therefore, the rent arrears of $686.57 and the water rates of $1093.52 are ordered. There were two water summaries submitted in the document bundle. During the hearing I referred to the one with a higher amount. I have reverted to the amount where the summary total is consistent with the same amount as claimed in the application.
The landlord declined any return of the filing fee. Suppression
Section 95A RTA states regarding suppression orders that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.
Further, the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.
The landlord requested suppression in its application. As it has been wholly successful, suppression is ordered.
I have also ordered suppression of the tenant details. They will be back in the rental market shortly. The monetary orders sought appear as much a reflection of possible confusion after changes in agents. The tenant was willing to address both claims. The landlord confirmed the tenants have been good. I consider it therefore in the interest of the tenants, with little downside to public interest, to accept the tenant request for suppression.
