Reasons

[Trustee 1], the trustee of the [Family Trust], attended the hearing via teleconference. The other trustee, [Trustee 2], was absent.
The tenant, Ms. Hansen, did not attend the hearing. I called the mobile number provided in the application twice and left two voicemail messages. My last call to Ms. Hansen was at 4:02 pm.
[Trustee 1] mentioned that it was difficult to reach Ms. Hansen. To his surprise, Ms. Hansen sent him a text message at around 10 am on 2 February 2025, indicating that she had not been well.
I have no evidence before me that Ms. Hansen is unwell. In any case, the total rent arrears as of today are $10,364.41, which is a significant amount owed.
While I acknowledge that Ms Hansen was paying her rent “at times,” there is no evidence of her making a committed repayment plan. Her absence from the hearing is telling. On that basis, it was challenging for me not to terminate the tenancy immediately.
The landlord has applied for termination of the tenancy and rent arrears.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
[Trustee 1] has requested that I keep the bond of $2,240 at the bond centre. He believes he will need to return to the Tribunal for additional claims. Filing fee
