Following the end of the tenancy, the landlord has applied for rent arrears, compensation for cleaning, rubbish removal and replacement of keys and furnishings, refund of the bond, and reimbursement of the filing fee.

The landlord says on an unknown date between 28 February and 2 March 2025, and without giving notice, the tenant moved out of the premises.

The landlord has not filed an application seeking termination for abandonment, rather, the landlord accepts the tenancy came to an end, and seeks rent arrears to 3 March 2025.

The landlord provided rent records which prove that as at 3 March 2025, the tenant owed rent arrears totalling $3,600.

The amount ordered is proved.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord did not have evidence to show the condition the premises was left in at the end of the tenancy. The landlord says the property manager who took photographs of the property at the end of the tenancy has since left the property management company, and the photographs they took, and/or exit report, were not uploaded to the company system.

Without evidence to demonstrate the condition the tenant left the property in at the end of the tenancy, the landlord has not proved the tenant failed to leave the property clean, remove all rubbish and/or damaged the carpet requiring professional cleaning. Accordingly, I dismiss the landlord’s claim for cleaning, rubbish removal and carpet cleaning.

The landlord requested (and was granted) further time to provide evidence that at the start of the tenancy, the premises were furnished with a washer and dryer, and photograph(s) to show both were missing at the end of the tenancy. The landlord also stated the pre-entry report made reference to the keys provided, so sought further time to file that.

Shortly after the hearing, the landlord filed a copy of the pre-entry report dated 29 August 2024 which shows the washer and dryer present in the laundry just prior to the start of the tenancy. However, the landlord did not produce a photograph (or any other record) to show the washer and dryer were not in the premises at the end of the tenancy.

While I accept the landlord has produced an invoice dated 22 May 2025 from Marewa Bargain Mart to show a replacement second-hand washer was purchased for $300 and a replacement second-hand dryer was purchased for $150, that is not evidence to show the supplied washer and dryer were not present at the end of the tenancy.

Similarly, the landlord was unable to produce evidence of the number of keys supplied to the tenant at the start of the tenancy for the front and/or back door, and garage door remotes. The pre-entry report dated 29 August 2024 does not list the keys or remotes provided, or how many.

Given the lack of evidence, I must dismiss the landlord’s claims for replacement washer and dryer, and for the keys and garage door remotes. Should the tenant reimburse the landlord’s application fee?

As the landlord has substantially (in a monetary sense) succeeded with the claim the tenant must reimburse the filing fee.
