The landlord had applied for rent arrears and termination. At the hearing, the landlord advised the tenant moved out of the premises on 27 April 2025, therefore an order for termination of the tenancy was not pursued.

How much is owed in rent arrears?

The landlord provided rent records which prove the amount owing in rent arrears as at 27 April 2025 was $18,740.00. An order is made accordingly.
The landlord also wished to pursue an order for compensation for the cost of disposing of rubbish, however that claim was not included in this application and I am not satisfied the tenant has been placed on notice of that claim. I note no evidence had been filed in support of a claim for compensation for the cost of rubbish removal, and I have made no findings in relation to the claim. The landlord is entitled to file a further application if he wishes to pursue the claim.
In this application, the landlord sought refund of the bond being $3,280.00. However, the landlord did not provide a bond number and enquires with the Bond Centre did not identify any bond held for this tenancy. The landlord wished to make enquiries with his accountant before considering whether to pursue a refund of the bond (in a new application). Should the tenant reimburse the landlord’s application fee?
As the landlord has succeeded with the claim the tenant must reimburse the filing fee. Should the landlord’s identifying details be suppressed?
