Both parties attended the hearing.

This is a tenant application. The tenants entered into a 12-month fixed term tenancy agreement with the landlord. The tenancy commenced on 27 October 2023. On the chattels list for the tenancy was, amongst other things, blinds and gas bottles. This was a newly built property, and the tenants were the first to occupy the property.

When the tenancy commenced the landlord had not provided the tenants with gas bottles nor blinds in the house. The gas bottles were for the hot water and cooking facilities. The tenants were without hot water and the ability to cook because of the lack of gas bottles for 7 days after the start of the tenancy. The property did not have blinds installed for 4 days into the tenancy.

The tenants seek two weeks rent in compensation for the lack of the gas bottles and blinds.

The landlord accepts that there should be some compensation given to the tenants for this. I have determined that the compensation should be $392.50 which is 50% reduction of rent paid over one week.

The tenants paid the full cost of the gas bottle hireage. The landlord is generally responsible for the fixed charges on gas bottle hireage in rental properties.

The landlord does not dispute this. The tenants have provided the Tribunal and landlord the fixed charges relating to the renting of the gas bottles. I am compensating the tenants $173.47 for this charge.

The tenants claim that there were several maintenance issues that the landlord failed to attend to during the tenancy: a) A noisy bathroom fan. b) The internal door between the lounge and garage was not locking and closing properly. c) The kitchen external ranch slider lock was difficult to open and close.

The tenants claim to have raised these issues with the landlord during routine inspections and sent an email on 5 July 2024. The landlord says the internal door was not required to lock and did not pose a health and safety issue. Furthermore, the bathroom fan worked, it was just noisy, and the ranch slider door was not remedied and should have been looked into.

I do not consider this to be a “lack of maintenance” issues in accordance with the Residential tenancies Act 1986 (“RTA”). However, the landlord should have investigated these issues in a timely fashion.

I accept that the internal door and the fan were not significant issues, and the door and fan provided the service that they were intended to provide.

I consider it appropriate that the tenant receive some compensation for the landlord’s lack of response to the requests for investigation and repair of these issues raised by the tenants. I am awarding the tenants $250.00 in compensation for the lack of response and repair of the ranch slider lock.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

The tenants have applied for suppression of their names and identifying details and as they have been successful, I am granting them suppression.
