Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
A tenant is not required to leave the premises clean to a ‘motel’ standard or to a point where a new tenancy can start or, as here, where the premises can be sold.
I have assessed the photographic evidence the landlord produced, and I have considered the evidence the parties gave to the Tribunal.
The landlord was assisted by friends to clean the premises and to tidy the exterior. They did not charge the landlord and she was not required to pay them. So, other than her own time, she has suffered no loss.
The landlord’s claims ($736.00 for lawns and garden work and $464.00 for cleaning) were pro rata amounts from quotes the landlord sought but did not accept. The Tribunal does not award compensation on that basis.
I consider that the landlord can reasonably claim for 5 hours of her labour for cleaning and for 7 hours of her labour for garden work assisted as she was by friends without charge.
I therefore award the landlord compensation of $360.00 in total together with the filing fee she paid to make her application. Result
The bond will be split between the parties - $387.00 to the landlord and $2,013.00 to the tenant. Name suppression
Both parties sought name suppression. Each has partly succeeded, the landlord with her claims and the tenant in defending them. There are other valid reasons for the suppression of the tenant’s name.
