Reasons

Both parties attended the hearing which was held by phone.
The landlord has applied for rent and water arrears. At the date the application was filed the rent was $1,789.75 in arrears.
The tenant advised that she is self-employed and that her income fluctuates. Once she became aware of the extent of the rent arrears she had been paying lump sums in order to clear the arrears.
The landlord and tenant have met to discuss and have agreed on orders. They both agree that the arrears as at today is $362.86. They agreed that the tenant will pay this sum to the landlord on Tuesday, 8 April 2025 and will continue to pay her usual rent as it falls due.
The amount owing for water was less clear. Both parties agreed that there were Watercare invoices outstanding that total $489.50. However the tenant said that she paid $200.00 towards these invoices (leaving a balance of $289.50) but that she paid it to the landlord’s account number but using an old suffix. The landlord said that they were investigating whether this payment has been made to one of their other accounts but it has been difficult to do so on an urgent basis due to it being the end of the financial year.
As the amount owing for water is yet to be determined I am unable to make any orders regarding the water arrears. However the parties are in close contact and agreed that they would discuss and agree a plan for payment once the amount was determined.
As the landlord has been put to the cost of filing this claim the parties agreed the order for rent arrears should include the reimbursement of the filing fee of $27.00.
These orders have been made by consent. I do not consider that there is any public interest in naming the parties as no determination has been made. I therefore exercise my discretion to suppress the parties’ names and identifying details pursuant to section 95A Residential Tenancies Act 1986.
