Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The application was filed on 28 February 2025. The landlord submitted a rent summary, which proves rent arrears were $7,264.28 (67 days) on this date.

The rent summary shows the tenant missed a number of payments of rent in April and May 2024. This is the period that rent arrears accumulated. Since June 2024, the tenant has consistently paid their rent when due.

The landlord gave evidence that the tenant receives assistance from Work and Income New Zealand (WINZ) and the Ministry of Social Development (MSD). The landlord gave further evidence that the tenant lives at the tenancy address with young children.

In these circumstances, the landlord requested that the Tribunal make an order for conditional termination to allow the tenant some time to pay the arrears in full. This might be achieved with the help of WINZ or MSD.

I consider this is an appropriate case to make an order for conditional termination. The tenant has consistently paid their rent since June 2024 and therefore, I am satisfied that they are unlikely to commit any further relevant breach. I also consider there is a strong likelihood that the tenant will be able to pay the debt within the period specified in the order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
