The landlord provided photographs and evidence of loss to support is claims. The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The following damage was caused during the tenancy: walls, doors, window latches, benchtop, light fitting above the bench. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.

The landlord provided evidence of the damage and repair costs. The landlord also provided an alternative quote for repairs. Where there is a discrepancy between the amount claimed and the quote, I have applied the lower amount.

The landlord also sought the cost of a replacement benchtop but will not incur that cost as the property has been sold. 1 It did incur the cost of a repair. I have awarded the repair cost. 1 Yin and Shelter Realty Limited v Waitai [2021] NZDC 23054

As the landlord was the successful party, I have awarded reimbursement of the Tribunal application fee and granted its request for suppression of its details.
