The landlord attended the hearing. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone but the call went to voicemail.
The landlord has applied for termination of the tenancy, rent arrears, water rates and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord had applied for water rates but was unable to provide evidence of how and when the invoices were sent to the tenant. In addition, the amount of water significant and worked out at more than $91.00 per week. The tenant had paid on average $15.00 per week for water but this was not enough. She owed a significant amount of money for water only six months into the tenancy, but the landlord failed to take any action until March 2025, almost four years later, by making this application.
I also note that there appears to be an error in the invoices from the water provider. In March 2023 the invoice amounts to $10,731.98. The reading is for 1857kl of water to a reading of 7295. In the invoice a year later (October 2024) the reading is 6589 so less than the reading the previous year.
Given the lack of evidence and the inaccuracies in the invoices, the water rates claim is dismissed.
