Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord provided extensive photographic evidence of the premises at the end of the tenancy. The photos show that the three bedroom property had not been left reasonably clean and tidy. An invoice for $747.50 was provided.

The landlord seeks compensation for the replacement of two smoke alarms. The landlord says that the alarms were not present at the end of the tenancy. A photo was provided in evidence. The tenant said that she had asked her son to replace the smoke alarms at the end of the tenancy. In this matter, I prefer the photographic evidence of the landlord, which shows that the smoke alarms had not been replaced. The landlord has provided an invoice for $230.00.

Some months after the end of this tenancy, but prior to a new tenant shifting in, the landlord discovered that there was a problem with the waste disposal. A contractor was called. The contractor’s invoice records that a plastic clip from a bread package and a clothes peg was discovered in the waste disposal. A photograph of the debris was provided. The items discovered are not items that should be placed in a waste disposal unit. I accept that the that this may have occurred carelessly, however the tenant is responsible for their careless acts. The tenant is ordered to pay the contractor’s invoice of $172.50.

The landlord says that the tenant has overpaid her rent. The amount of the overpayment is $172.50 and that should be deducted from any amount which the tenant is ordered to pay.

On 7 August 2024, the Tribunal ordered the tenant to pay the landlord $6,169.99, less the bond then held by the Bond Centre of $2,720.00.

On 24 January 2025, the Tribunal ordered the tenant to pay a further $2,147.21 to the landlord under TT 5033831. An error was made in the order, in that the bond was ordered to be released again by the Bond Centre, thus reducing the amount owed by the tenant. I have incorporated the order in TT 5033831 in this order. I record that I have checked with the Bond Centre. The Bond Centre details show that there is no bond money held by them in relation to this tenancy, it having been released previously. The previous order is incorporated into this order for enforcement purposes.

As [The applicant/s] has wholly succeeded with the claim I must order the tenant to reimburse the filing fee.

Both parties have applied for name suppression. The landlord has been wholly successful in this matter and suppression of the landlord’s name and details is ordered. The tenant has not been wholly or substantially successful in this hearing and the tenant’s application for name suppression is dismissed.
