Reasons

Only the landlord appeared at the hearing today. I am satisfied the tenant has been properly notified of the hearing. In that regard, I note the parties have been to mediation, which the tenant attended, so I can be confident that the tenants details held by Tenancy Services, are correct.

At the hearing today, the landlord advised that he purchased the property in 2019, and was renting it on a room-by-room basis to his employees. Mr. Gaoa requested to rent the whole property, and a tenancy agreement was entered into between the parties on 1 November 2021.

The tenancy agreement records the landlord as [The landlord/s], and the sole tenant as [The tenant/s].

The rent record has been provided, which shows that the rent payments were made reasonably regularly in 2021, that from later in 2022, The rent arrears started to increase significantly. By 2024, there were only very intermittent rent payments made, although there was a regular $10 payment received which the landlord advised me was from MSD. Beyond those $10 payments, the last substantive payment of rent was made in May 2025.

The rent record provided shows that the current arrears total $63,590.00.

I asked the landlord how the arrears got to that level. Mr Minh advised me that the tenant’s partner had health issues, and I took the landlord to mean that he provided considerable latitude because of that. However, in March the landlord provided a notice regarding the rent arrears, but that notice did not resolve the problem. The landlord states that the reason given by the tenant for not paying the rent, was simply that he did not have the money to do so.

In any event, I am satisfied that the claimed rent arrears have been proven, so the claimed arrears are ordered in full.

The landlord also states that a notice terminating the tenancy was given by him, and not complied with. Within that, the landlord provided a skip bin which the tenant used, but then advised he would not be moving out.

The Residential Tenancies Act 1986 (RTA) applies. Section 55 of the RTA confirms that in a case where the landlord applies for termination of the tenancy, if the rent is more than 21 days in arrears, the Tribunal shall order termination of the tenancy. In this case, the rent arrears are vastly beyond that 21 day level, and so termination of the tenancy is ordered.

It his application, the landlord also applied for compensation for damage to the premises. As I explained to the landlord today, that claim would be premature. The proper process would be to obtain possession of the Tenancy (which I have now ordered), and then once the landlord has possession, he can properly determine what damage has occurred to the premises, then the landlord can lodge a new claim with the Tribunal, and we would consider it at that time.

Because the landlord has been wholly successful in his claim, the filing fee paid to commence the proceeding is ordered to be paid by the tenant.
