Background

The background to this application is set out in the adjournment order dated 30 May 2025. In brief, there was a fire at the property on 19 January 2025 that caused extensive damage. The fire originated in a shed on the property, where the tenant’s partner was growing cannabis under lights. It spread to the carport and then to the house.
In the 30 May decision, I made orders for rent arrears, water rates, and exemplary damages. The hearing was adjourned to allow the landlord to provide further evidence around the cost of repairs.
The second hearing took place by phone on 31 July 2025. Both parties participated in the hearing. Ms Robinson represented the landlord. Repairs
[The tenant/s] is legally liable for the damage because it was result of an act by a person for whose actions she is responsible 1 , that occurred on the premises, and that constitutes an imprisonable offence. 2
The repair work has been completed. As noted in the previous order, the landlord did not have insurance and has borne the cost of repairs.
The invoices provided for the repair work were somewhat basic.
The additional evidence that Ms Robinson has provided is an estimate prepared by [Contractor Company]. [The Contractor] is an LBP. [The Contractor] prepared the estimate on the basis of photographs of the damage.
The estimate is for $36,800.00 including GST, inclusive of trailer hire and electrical repairs ($5000 allowance for electrical).
[The Contractor] is a qualified and experienced builder, and his estimate is useful and relevant evidence.
I am satisfied that the repair costs presented by the landlord, including electrical costs, replacement of downpipes, boarding up then re-glazing of windows, and trailer hire, are actual and reasonable. Other costs
The cost of cleaning (separate from and additional to clean up after the fire) is proven and is fair and reasonable. 1 Section 41 Residential Tenancies Act 1986 (“RTA”) 2 Section 49B(1)(b) RTA
The landlord has been successful in this application and I must also award the landlord the filing fee of $27.00.
At the hearing, Ms Robinson clarified that a bond of $1,080.00, which was held for this property, has been released to Mid North Real Estate. I have credited this amount in the calculation above. Name suppression
The Tribunal may grant name suppression to any party “having regard to the interests of the party and to the public interest”. 3
My finding is that it is appropriate to grant name suppression to the tenant in this instance. The damage was caused by the illegal activities of the tenant’s partner. The tenant is liable for the cost of that damage, but it would be unjust to potentially further penalise the tenant by publication of her name.
