Apart from the rent, Coradean Louisa Maan will no longer be responsible for the tenancy premises after 1.00pm on Tuesday 8 April 2025.

Both parties attended the hearing.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord. See section 61 Residential Tenancies Act 1986 (RTA).
I am not persuaded the tenancy has been abandoned. The tenant told the property manager that she would be moving out. The application for termination because of an abandonment is dismissed.
The tenant signed a fixed term tenancy agreement and the landlord wants to be able to advertise and find new tenants. The tenant has moved out and agreed the landlord can have possession of the house from 1pm tomorrow, after the tenant cleans and leaves the keys on the kitchen bench. This will make it easier for the landlord to find a new tenant.
It is my intention that the landlord will be responsible for the house and gardens from 1.00pm tomorrow. The tenant will not have any access to the tenancy premises after that time.
I note this is not the end of the fixed term tenancy. The landlord said she has tried to explain the break lease process to the tenant but the tenant will not engage.
The tenant should get some advice about ending a fixed term tenancy.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing to tomorrow, 8 April 2025.
I find the tenant still has an obligation to pay rent because she signed a fixed term tenancy. The landlord can bring a further application for rent. It will be up to the next Adjudicator to decide what the tenant owes.
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee. Other orders
The landlord’s application for suppression is allowed because the landlord is the most successful party. The tenant’s name will be published because there is public interest when tenants owe money. See section 95A RTA.
The balance of the bond should be held because it seems likely to me the tenant will have to pay more money to the landlord.
