The tenant did not attend the hearing by Teams video link. A telephone call was made to the tenant on the number provided at the allocated hearing time. There was no response to the call. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing was given to the tenant.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy agreement signed by the parties records that the tenancy agreement was to have commenced on 6 March 2025. The landlord provided a copy of e-mail correspondence between the parties agreeing to a variation to the original start date, so that the tenancy would commence on 15 March 2025.
Prior to the tenancy commencing, the tenant advised the landlord that they no longer wished to proceed with the tenancy. The tenant had already entered into a contract with the landlord to rent the premises. The landlord has accepted this as the tenant providing the landlord with 21 days’ notice of termination of the tenancy. The tenancy has accordingly ended on 5 April 2025. The tenant is ordered to pay rent arrears of $2,100.00 to the landlord.
The landlord seeks compensation for advertising fees of $391.00 incurred by the landlord in attempting to find replacement tenants.
Section 44A of the Residential Tenancies Act 1986 (“RTA”) allows a landlord to recover expenses reasonably incurred where the landlord has consented to an assignment, to a subletting or to a parting with possession under section 44 RTA or to termination of the tenancy in accordance with section 50(1)(d) RTA.
