An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
The tenancy of Doris Sina Lemalu and Jaycinta-moe Faauli at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 5pm on Monday 30 June 2025 subject to the following: a. The tenants are to pay current weekly rent of $690.00 for the remaining period of the tenancy on time. b. If the tenants fails to pay rent when it falls due the tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises.
Doris Sina Lemalu and Jaycinta-moe Faauli must pay [The landlord/s] $27.00 immediately, calculated as shown in the table below:
The Bond Centre is to pay the bond of $2,760.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

The hearing was held by teleconference. The representatives for the landlord attended. Ms Lemalu attended for the tenants.
The landlord has applied for termination of the tenancy, recovery of rent arrears, and a refund of the bond.
On the date the application was filed, the rent was at least 21 days in arrears. Under section 55(1)(a) of the Residential Tenancies Act 1986, this constitutes valid grounds for termination. The tenancy is therefore terminated on this basis.
The landlord provided rent records that clearly establish the amount of rent owing.
While the tenants claim to have transferred $1,380 towards the arrears, the landlord advised that the payment had not yet cleared and would not appear in the rent account until the following day. Once received, this payment will be applied to reduce the arrears.
In addition to the rent arrears, the landlord noted that there are outstanding water rates, which also remain the tenant’s responsibility and will need to be addressed separately.
Despite being entitled to immediate termination, the landlord has elected to defer the termination of the tenancy until 30 June 2025, conditional on the tenants paying rent in full and on time for the remainder of the tenancy. If the tenants fail to meet this condition, the tenancy will terminate immediately without further notice.
