Reasons

The landlord attended the hearing, the tenant did not attend. I have checked and the tenant was served with a notice of hearing. The tenant has not been in contact with the Tribunal seeking an adjournment. I am continuing with the hearing in the absence of the tenant.

The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and refund of the bond.

In addition to these claims the landlord sought exemplary damages after being assaulted by the tenant’s partner. Section 55(1)(c) of the Residential Tenancies Act 1986 (RTA) says the Tribunal shall end a tenancy where the Tribunal is satisfied that the tenant has assaulted, or has threatened to assault, or has caused or permitted any person to assault, or to threaten to assault, the landlord or any agent of the landlord, or any occupier of the same complex, or any neighbour.

The tenants partner Joseph Wright intimidated and physically assaulted the landlord when she came to speak to the tenant about outstanding rent arrears.

Mr Wright is residing at the tenancy without the consent of the landlord. He was standing in the doorway of the property when the landlord came to speak with the tenant. Mr Wright approached the landlord and began verbally abusing her on the driveway/path outside the property. Mr Wright grabbed the landlord by the shoulders and intimidated her. She managed to run to her car, but Mr Wright blocked her way and refused to allow her to leave. He continued to verbally abuse her while banging on her car. The landlord rang 111 as she was genuinely concerned for her welfare. Subsequently the police were involved, and a complaint of assault made. The landlord has provided the Tribunal with a copy of the police incident report.

The landlord seeks exemplary damages for the assault and intimidation. I cannot award exemplary damages for this as it was not the tenant who caused the actual harm. While I cannot award compensation or exemplary damages, I do believe this incident warrants immediate termination of the tenancy, in addition to the large rent arrears owing. Termination for rent arrears:

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing of $9307.14 at the end of the tenancy.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
