The tenancy commenced on 21 December 2024 and was fixed for a 12-month period. In February 2025, the tenant advised the landlord that she had to move back to Hamilton due to a family emergence and needed to break her fixed term tenancy.

The landlord advised the tenant of the process to terminate the tenancy early and the associated costs. The tenant agreed to those terms. The tenant left the property in February 2025 but kept all her possessions in the property until 24 May 2025.

The landlord obtained a new tenant who took over the property on 25 May 2025. Landlord claim:

The landlord has applied for rent arrears to 24 May 2025 and has provided rent records which prove the amount of $4075.57 owing.

The tenant accepts that she owes this amount in rent arrears.

I am satisfied that the landlord has proven their claim for rent arrears. Compensation:

The landlord provided invoices for the costs associated with the break of the fixed term tenancy. The landlord seeks $632.50 in fees to replace the tenant early.

The tenant accepts she owes these costs. I am satisfied that the landlord has proven their claims for the break lease fees. Tenant claim:

The tenant has applied for reduction of the fixed-term tenancy that was due to end on 20 December 2025.

The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986.

There has been an unforeseen change in the tenant's circumstances. The tenant advised that a close family member suffered a life-threatening illness and she needed to go back to Hamilton to assist the family with this medical crisis.

In addition, her flat mate left the property permanently at short notice. The tenant was not living in the property and could not afford to pay the rent after she lost her job and her flatmate left.

The tenant would suffer severe hardship if the term of the tenancy were not reduced.

The landlord would suffer hardship if the term were reduced. However, the landlord accepted that the tenancy would end but sought the rent to be paid until a new tenant was found.

I find that the tenant’s hardship would be greater than the landlord’s hardship.

Where the Tribunal reduces a fixed-term tenancy, it may order the tenant to pay the landlord reasonable compensation for any resulting loss. See section 66(2) Residential Tenancies Act 1986.

I award compensation of $4075.57 to the landlord, taking into account the rent until 24 May 2025 when a new tenancy commenced.

For completeness I have ordered that the tenancy ended at11.59pm on 24 May 2025.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

The bond centre is to refund the bond to the landlord immediately to offset the debt owed by the tenant to the landlord.
