Reasons

The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes.
I was satisfied it was appropriate to deem service had completed (see s 91B(2)(c) Residential Tenancies Act 1986) and I continued with the hearing after the second call also went unanswered.
The landlord has applied for compensation for rubbish removal, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. A rent credit existed and has been applied against the debt.
This was a long tenancy of some eight years. It ended via tenant notice to terminate.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not remove all rubbish.
The landlord provided a detailed invoice and many photos as evidence of the need. Based on the evidence, I consider the large cost incurred has been established as tenant liability. The delay in bring this application was due to a protracted engagement with the tenants who acknowledged their liability (in writing) but who failed to confirm bond release and repayment terms with the landlord, hence this later application.
The amounts ordered are proved. Filing fee
Because Braziers Limited As Agent For David Van Dijk And Mingxia Sun has wholly succeeded with the claim I must reimburse the filing fee.
