[The tenant] owes Kāinga Ora–Homes And Communities $3,064.29 (“the debt”), calculated as set out in the table below:

[The tenant] must pay rent and the debt as follows: a. By 102 weekly payments of $194.00, being $164.00 for rent and $30.00 for the debt. b. A final payment of $168.29, being $164.00 for rent and $4.29 for the debt. c. Payments will be every Thursday, with the first payment on 26/06/2025 and continuing until 10/06/2027.

Payments will be allocated in the following order: rent and rent arrears.

If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

The landlord attended the hearing. The tenant did not.

I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend. I tried to call the tenant twice on his current mobile number, but he did not answer the calls. The landlord confirmed it had spoken with him on Monday and that he knew about today’s hearing, committed to attending and had agreed to the terms of this conditional termination order with his tenancy manager.

The landlord has applied for termination of the tenancy and rent arrears. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Name suppression

The landlord applies for non-publication of the tenant’s name and identifying details as he has recently been incarcerated and his government benefit stopped as a result. Consequently, he has been unable to pay rent as he has had no income. His benefit has been reinstated and he has signed a form allowing WINZ to pay his weekly rent and debt repayment sums directly from his benefit. The landlord says the tenant is being proactive in assisting it in addressing the debt.

I do not consider publication of the tenant’s name and identifying details is in the public interest or justified because of his conduct or any other circumstances of the case and that publication could have an adverse impact on his ability to get housing in the future. Therefore, I have used my discretion to grant him name suppression.
