The applicant tells me that sometime around the beginning of June 2025 the respondent reached out and informed them that they would be vacating the tenancy the 13 th of June 2025. The applicant tells me that even though they did not receive the required 21 days’ notice they accepted this and are only claiming rent arrears to the 13 th of June 2025.
The rent arrears records provided by the applicant are unusual. They consist of a rent summary showing rent owing of $2695.71 and an invoice balance of $1170.00. The applicant tells me this came about because they applied a credit of $2480.00 to the respondents rent account on the agreement that this would be invoiced. The respondent subsequently made a series of payments towards this invoice and a balance of $1170.00 remains. The rent arrears owing to the 13 th of June 2025 is the sum of this rent invoice balance and the rent arrears reflected in the rent summary.
I caution the applicant from this practice going forward. It undermines the clarity of rent records and is likely to confuse anyone trying to make sense of them. Having said that I am satisfied that the applicant has acted in good faith, and in the best interests of the respondent, and that the convoluted records are nevertheless accurate.
