The landlord has applied for rent arrears, outgoings, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent and Water

The tenancy ended on 31 March 2025 when a mediated order was enforced. The landlord provided rent records and water invoices which prove the amount owing at the end of the tenancy. The water charges total $578.27 after deduction of a $50.00 payment. Cleaning, Rubbish Removal, Locks

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. The tenant must also replace standard light bulbs.

The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The tenants had pets without permission and there was a smell of pet urine from the carpets and the vinyl flooring in the kitchen and bathroom. The vinyl flooring had to be removed so that thorough cleaning could be performed and then reinstalled. The carpets in the hallway and garage were stained. Items of rubbish were left behind, including a fridge and a dishwasher ($852.50 + $287.50).

The cleaning costs are high ($1,644.50) but at least a basic move-out clean was required for this 2-storey 4-bedroom property, at a cost of $862.50. Cleaning under the vinyl flooring to remove the smell added a further $276.00. The remaining costs were for cleaning windows and walls. The landlord’s photographs are small but do show a need to clean the flooring and the kitchen especially. Overall, I am satisfied that the cleaning costs are reasonable.

The tenant did not return the keys. The locks had to be changed for security reasons, including the garage remote ($294.88 + $218.50).

The landlord had to replace light bulbs ($307.58). Damage

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

The carpets had to be replaced throughout the house due to pet damage. The landlord has only claimed the excess of $437.50 (equal to half a week’s rent) although the actual replacement cost must have been much higher. There was a cost to uplift and dispose of the damaged carpets ($1,092.50). An oven seal had fallen off the oven door, but the tenants continued to use the oven without replacing it, causing damage to the oven ($287.50). The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.

The tenant agreed to pay for a lock to be fitted to an internal door at their request ($92.00). Filing Fee and Name Suppression
