An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant’s and Landlord’s name and identifying details. The landlord’s application was made for suppression of her details only, and the tenant did not attend the hearing. However, as discussed below there are

to believe that the tenant and her children may be at personal risk of violence from her former partner and his associates who appear to be responsible for the bulk of the damage and issues at the tenancy. Therefore, I suppress the tenant’s name and details as well.

The landlord attended the hearing which was held remotely. I made two attempts to contact the tenant via the number provided, however, these calls were not picked up. I decided to proceed in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond. On the claim form there were also claims for compensation for damage to the property, however, after discussion the landlord withdrew these claims so that they can be brought once she has re- entered the property and has conducted the repairs which will be required for the extensive damage caused by the tenant, her former partner, and his associates. Background
The tenancy began in October 2023, and was renewed for a further term of one year on 15 November 2024. It appears the tenant had complied with their obligations and responsibilities until November 2024, when her now ex-partner moved in.
In January 2025, a rent payment was missed, the landlord corresponded with the tenant, and the arrears were caught up on.
In February 2025, a further repayment was missed, and subsequently the arrears have become more frequent and have never been caught up on.
At a property inspection on 19 February 2025, the landlord noticed men’s clothing and the property. Shortly after the property manager advised that visitors to the property causing an issue the neighbours, and car repairs were being conducted on the property.
In March 2025, the property manager became aware of car bodies being left on the property and that the front fence had been cut down. The landlord became aware that the tenants then partner had moved in in November 2025.
In mid April 2025, a notice to inspect the property was served on the tenant, who refused to allow entry. As the month progressed into May, the landlord and the property manager became aware of a number of significant issues including security cameras being ripped off the house, broken windows, and other damage. The tenant asked about terminating the tenancy early. Subsequently the landlord has become aware that the tenant’s former partner has gang connections, and his associates often stayed at property. It appears that the partner had become violent towards the tenant, the associate had been arrested from the property for alleged possession of stolen motorcycles, and that the tenant has trespassed, or otherwise sought protection orders, against her former partner.
On 17 May 2025, the landlord visited the property and noted that it appeared the tenant had abandoned the tenancy. At this visit landlord became aware of the fact that there was extensive damage to property including: a. The aluminium door joinery had been altered by screwing tek roofing screws through the body of external doors into the frames. This prevents the doors are being opened at all. This appears to have been done by the tenant to prevent her former partner from entering the tenancy. The landlord is unable to open the doors, and the only entrance is by removing a Perspex door panel in the door which enters the garage. b. An approximately 5 m long section of the front fence has been cut down, presumably to allow vehicle access. c. The door has been ripped off the garden shed allowing water and wind damage to the contents. d. Broken windows which had allowed water and wind damage to carpets and internal fittings. e. Damage to walls. f. An internal door and the garage has been removed.
I note that the landlord’s claim for compensation for damage to these items is not being pursued with the current application, as she has not been able to re- enter to properly assess the cost to repair damage. The landlord advises that a further application will be made for these costs, along with the costs of cleaning, and the loss of rents due to the early termination of the lease.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 17 May 2025, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
As the termination has occurred before the end of the term of the tenancy the landlord has suffered a loss, however, the extent of this loss will not be known until the repairs have been carried out the property are tenanted. The landlord advises that these losses will be sought in a later claim.
