Reasons

The landlord attended the hearing. The tenants were contacted on the phone numbers provided in the application. These are also the same numbers in the tenancy agreement.

The landlord is seeking rent arrears to the end of the tenancy on the 31 December 2023, reimbursement of the filing fee and payment of the bond.

The landlord attempted to file a previous claim with the Tribunal after the tenancy ended, but for reasons unknown did not complete that form.

At the time the tenancy ended in December 2023 the law provided that if a landlord filed a claim more than 2 months after the tenancy ended, the landlord had to provide an updated address for service (usually the tenants’ new address) or seek substituted service by another means such as email or seek to dispense with service. A landlord could not automatically use an email address for tenants as an address for service, even if it was listed as such on a document.

On the 30 January 2025 changes to the way parties could be served with applications came into force, this allowed tenants to be served by email. Section 91A RTA provides: (2) If the landlord files an application more than 2 months after the termination of the tenancy to which it relates, any notice or other document required to be served on the tenant relating to the application must be given to or served on the tenant— (a) ... (e) if the landlord files the application no later than 2 years after the termination of the tenancy to which it relates, by transmission to an email address given by the tenant as an address for service; or (f) if the landlord files the application more than 2 years after the termination of the tenancy to which it relates, by transmission to an email address that the tenant has used to communicate with the landlord, or otherwise supplied to the landlord in writing, within the 2 years before the application.

The email addresses given by the landlord in the application were those listed in the tenancy agreement and on the bond lodgement form. The email addresses are not listed as addresses for service in the tenancy agreement but are listed as such on the bond lodgement form which the tenants signed, therefore I am satisfied that as the application has been served on the tenants at those addresses I am satisfied that the requirements for service under s91A(2)(e) have been met.

The landlord has provided me with a rent ledger that shows the rent amount owed.

The landlord has been wholly successful in their claim and I award the landlord the filing fee and grant them name suppression as requested.
