Reasons

Both parties attended the hearing.
The tenancy commenced on 28 July 2024 and was scheduled to end on 28 July 2025. The tenant applied for reduction of the fixed-term tenancy.
The Tribunal may reduce a fixed term tenancy in accordance with section 66(1) Residential Tenancies Act 1986 (RTA), and there are a range of considerations the Tribunal must take into account in doing so.
However, the correspondence shows that the landlord agreed to reduce the fixed term tenancy if the tenant gave 21 days’ notice of their intention to vacate (in accordance with section 51(2A) of the RTA). I am satisfied that at this time the landlord agreed to effectively reduce the obligations of the tenant to that of a periodic tenancy in terms of what was required to leave the tenancy.
It is therefore not necessarily to canvas the reasons for the reduction in the fixed term tenancy and the factors outlined in section 66(1) of the RTA. The issue instead becomes about when the tenancy ended.
The tenant believes they gave notice on 19 April 2025. The email referred to states that “we will start looking for another house and will let you know as soon as we found one”. They have provided correspondence that shows that when they previously raised maintenance concerns, the landlord had told them they could find another property.
They moved out on 17 May 2025 and so are of the view that they gave 30 days’ notice prior to vacating and therefore should have their full bond returned.
However, on review of the correspondence I find that they did not effectively give notice until 11 May 2025. It is at this time they say, “we have found another house and will be moving out Saturday 17 th of May”.
Prior to this email, the landlord did not have a date from which they could re- tenant the property and it is quite reasonable that it could have taken months for the tenant to find another property, and for the tenants to move out.
Accordingly, it is fair and reasonable that the tenant is liable for rent until 1 June 2025 being 21 days from 11 May 2025 when the notice of termination and the intention to vacate was given.
This means the tenant is required to pay rent in lieu of notice through to 1 June 2025, amounting to $1,350.00 and accordingly the bond is directed to be refunded to the landlord.
In addition, the tenant had two days of outstanding rent prior to moving out of the property. This is therefore included in the total amount of rent payable.
The landlord also claims for outstanding water rates owing of $50.95 at the end of the tenancy, and the tenant did not dispute this amount at the hearing. The amount ordered is proved. R Harvey-Lane 12 June 2025
