Both parties attended the hearing. Ms Davis attended for the landlord.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The tenant did not want his tenancy to end, he wants to remain living at the property. He said that he got into arrears due to a family bereavement and accepts that he should not have allowed his rent to get behind.
The landlord sought termination. The landlord says that the tenant has a history of arrears.
S55(1)(a) RTA provides that the Tribunal shall terminate the tenancy if the rent was 21 days in arrears at the date of application. The rent was more than 21 days in arrears at the date of the application, and as the landlord is asking for termination I must terminate.
I have declined to grant a conditional termination as I am not satisfied that the tenant would not commit further breaches. The tenant has a history of rent arrears.
I have allowed the tenant a week to try and find alternative accommodation. The bond is to be used to pay the rent arrears and the week’s rent.
Because Waiheke Property Co. Limited As Agent For Floyd Hunwick has substantially succeeded with the claim I have reimbursed the filing fee.
