Reasons

The landlord attended the hearing today. There was no attendance by the tenant.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy. Cleaning, Rubbish Removal, Locks
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The carpets and walls in the lounge were covered in paint and were extremely messy. The kitchen flooring was dirty. The kitchen cupboards and the oven needed cleaning. The landlord’s photographs show some belongings left behind (for example, a child’s buggy) and rubbish in black bags outside.
The landlord claimed $1,127.00 for general cleaning. I allow the claim for an exit clean ($450.00 plus GST) and the cost of cleaning the paint ($70.00). I am not satisfied that the condition of the property supports the remaining claim for general cleaning. I accept that the carpets needed cleaning, and this was a reasonably large property with 4 bedrooms. The invoice noted that the carpets were steam-cleaned twice and treated for stains. I also note that the broken windows had left shards of glass strewn on the carpet.
The tenant did not return all the keys. The tenant had misplaced the ranch slider keys, so the locks had to be changed for security reasons.
The lawns needed mowing. Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent.
Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent).
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
There was damage to the glass in two exterior doors, and to the doors and walls of all 4 bedrooms. There was damage to the hallway wall and door and a smoke alarm had been removed.
