An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name.
Kiriwai Stacey Mere Hikatangata must pay [The landlord/s] $5,598.43 immediately, calculated as shown in table below.

Reasons

Both parties attended the hearing which was held by telephone.
The landlord has applied for termination of the tenancy, rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

Should the tenancy be terminated?

The landlord applied for termination of the tenancy on the grounds that the tenant was at least 21 days in arrears at the date of the application.
The landlord’s application was made on 16 May 2025. At that date the landlord’s rent summary shows that the tenant was $1,971.43 in arrears. Rent is $1,200 a week. For the landlord to have been successful in its application the tenant would have had to have been $3,600.00 in arrears at the date of the application.
Accordingly the landlord’s application is dismissed.
At the hearing the landlord’s representative raised that she had uploaded 14- day notice/s issued to the tenant for failure to pay rent and asked that termination be considered under those notices, on the basis they had not been remedied. However, the digital file, which I have access to, does not have any 14-day notices uploaded by the landlord. Regardless, the landlord’s application would need to have specified this ground as a ground it was seeking to terminate the tenancy on for me to be able to consider it as part of this application, which it does not.

The landlord provided rent records which prove the amount owing in rent arrears as ordered. Other matters
As the landlord has been successful in its rent arrears application reimbursement of the filing fee by the tenant is awarded.
The landlord applied for a name suppression order. I am satisfied that it is appropriate to award the landlord name suppression as its application for rent arrears has been successful (section 95A Residential Tenancies Act 1986).
