The tenant has applied for reduction of the fixed-term tenancy due to end on 3 August 2025. Reduction of fixed term tenancy

The tenant had requested that the landlord reduce the fixed term tenancy. The landlord had been willing to this, however, it was on the basis that the tenant cover rent until a new tenant was found or the tenancy term ended (whichever came earlier), as well as paying costs associated with breaking the lease. The parties were unable to reach an agreement.

The tenant moved out of the property on 30 June 2025. The property has not been re-tenanted.

The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and a. there would be severe hardship to the applicant if the term is not reduced; and b. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986 (RTA).

There has been an unforeseen change in the tenant's circumstances. The tenant detailed personal information about the abusive relationship she was in with her ex-partner, who had unexpectedly moved out of the property in September 2024. She described the significant stress related to her experiences at the tenancy address. The tenant had increasingly become unwell and has provided a letter from her general practitioner confirming support to end her tenancy early to reduce the ongoing impact on her wellbeing.

The tenant would suffer severe hardship if the term of the tenancy were not reduced. She has now moved out of the property and is unable to continue to cover rent for this tenancy.

The landlord would also suffer hardship if the term were reduced. The property has a mortgage and there will be financial losses and difficulties suffered if the tenancy term is reduced.

I have reviewed all evidence provided and am satisfied that the tenant’s hardship would be greater than the landlord’s hardship.

Where the Tribunal reduces a fixed-term tenancy, it may order the tenant to pay the landlord reasonable compensation for any resulting loss. See section 66(2) RTA.

I award compensation of $1,618.25 to the landlord, which includes two weeks rent amounting to $960.00 and the invoiced break lease costs of $658.25.

It was clear during the hearing that the landlord likely didn’t have all the information on why the tenant wanted to break the lease. Although I appreciate the tenant’s position, and fragility in the circumstances, I think it is fair and reasonable for the landlord to receive the awarded compensation. This also reflects that the tenancy was scheduled to end in less than one month, and the landlord may have further rental losses when seeking to relet the property during that time.

Because [The applicant/s] has wholly succeeded with the claim of reducing the fixed term tenancy, I must reimburse the filing fee.

The tenant requested name suppression and since she has been successful in her claims, this is granted. The landlord did not seek name suppression, however, in my view and given the nature of the evidence given and detailed in this decision, I have on my own initiative determined that it is in the best interests of the tenant for the landlord’s name to also be suppressed, to reduce the possibility of identification. In my view, these interests outweigh any public interest in publication. See section 95A of the RTA. R Harvey-Lane 09 July 2025
