Reasons

Both parties attended the hearing.

The tenants have applied to reduce the term of their fixed term tenancy.

The landlords have applied for payment of rent arrears.

The fixed term tenancy was due to end on 6 December 2025.

The tenants bought a property for themselves and asked the landlords in early April to be released from the tenancy. The landlords said that they would try to find another tenant but until then the tenants would have to continue paying rent.

The tenants paid the landlord money to cover advertising costs as requested and the landlord advertised the property and had enquiries and viewings without success. They have only now found another tenant to the take the premises from 10 August 2025.

I accept that the tenants did not fully appreciate the nature of a fixed term tenancy or that they had the option of allowing the previous fixed term agreements to roll over to a periodic tenancy. But that does not affect their obligation to honour the fixed term agreement that they signed.

I accept that the landlords, having agreed to find another tenant, had a responsibility to take reasonable steps to do so. Their evidence was they did so, and I accept that.

There is no other reason to reduce the term of the tenancy. There has been no unforeseen change in the tenants’ circumstances and so s66 of the Residential Tenancies Act 1986 does not apply.

It follows that the tenants are liable to pay rent until 9 August 2025.

The landlords produced a rent statement showing that the rent due to 9 August is $4,096.43 and the tenants accepted that.

I have therefore ordered the tenants to pay the arrears and the filing fee. Their application must be dismissed.

The parties agreed that the bond will be paid to the landlords and the balance of the money due will be paid at the rate of $50 per week. I have made a payment order in those terms.

The tenants have requested name suppression. Although they have not succeeded, I have sympathy for their position. They have been good tenants and they have found themselves in this situation due to their unfamiliarity with tenancy law. There is no public interest in identifying them and so I have granted them name suppression.
