Reasons

The landlord attended the hearing via remote video conference. There was no attendance by the tenants. Attempts were also made to contact the tenants on the telephone numbers provided with the application. Both attempts were unsuccessful.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 10 April 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord states that they undertook an inspection on this date and discovered that the tenants had abandoned the property. They keys had also been left behind.
The tenants were subject to a fixed term tenancy of 6 months from 26 December 2024 to 25 June 2025.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing up until 1 June 2025. Having sighted this evidence I am satisfied that the tenants are responsible for this debt.
The claim for rent arrears is proven.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The landlord claims that the tenants did not leave the premises clean and tidy. The landlord has not provided any evidence in support of this claim other than an invoice for $400.00.
The onus is on the applicant to prove their claims on the balance of probabilities. In the absence of entry and exit photographs which confirm the state of the premises at the beginning and end of the tenancy the claim for cleaning costs must be dismissed.
Because Auckland Property Management Limited As Agent For Derek Pullen has substantially succeeded with the claim I have reimbursed the filing fee.
The landlord confirmed during the hearing that they are not seeking an order for name suppression.
