The landlord attended the hearing. Two attempts were made to contact the tenant on his last known mobile number, which he answered approximately three weeks ago. However, no further contact could be made, and the hearing proceeded in his absence. Name suppression

As at the date the application was filed, the rent was at least 21 days in arrears. Accordingly, termination is granted under section 55(1)(a) of the Residential Tenancies Act 1986.

Under section 56(1) of the Act, the Tribunal may also terminate a tenancy where a breach has occurred and, having regard to its nature or extent, it would be inequitable to refuse termination.

Where a breach is capable of remedy, the landlord must first serve a written notice requiring the tenant to remedy the breach within a minimum of 14 days and must establish that the tenant has failed to do so.
