Reasons
- Both parties attended the hearing which was held by teleconference. Ms McGilivray represented the landlord.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Mr Te Kura said that what Ms McGilivray said was perfectly true, but he didn’t wish to leave the premises. He said he was trying to get some money from a relative to address the arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at today’s date is $8,087.14.
- Because Goodtenant Limited - As Agent For R & J Family Trust has wholly succeeded with the claim I must reimburse the filing fee.
