On 9 June 2025, the landlord filed an application with the Tribunal seeking termination of the tenancy and rent arrears. The landlord relied on the following grounds: a. The rent was at least 21 days in arrears at the file the application was filed, section 55(1) of the Residential Tenancy Act 1986 (the “Act”). Rent arrears

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The tenancy commenced on 8 May 2024 and the rent set at $152.00 per week. The rent records indicate the tenant complied with their rent obligations until 13 May 2025 when five rent payments were missed.

On 3 June 2025, the tenant’s rent was reduced to $90.00 per week.

On 7 June 2025, the tenant made one rent payment of $186.00.

The facts of the case are unusual. The rent reduction on 3 June 2025, from $152.00 per week to $90.00 per week, resulted in the tenant being more than 21 days in rent arrears when the landlord filed their application. At that time the tenant’s rent arrears totalled $360.00.

The landlord provided up-to-date rent records that show at the date of hearing the tenant’s rent arrears totalled $84.00.

The landlord today seeks a conditional termination order.

The landlord states the tenant has arranged for their rent to be paid directly to Kainga Ora from their benefit. The landlord also said the tenant had worked with a sustaining tenancies organisation to have MSD to pay off a significant portion of the rent arrears.

Section 55(2) of the Act states the Tribunal may refuse to make an order under s55(1) if, but only if, it is satisfied that the beach has been remedied, the landlord has been compensated for any loss arising out of the beach, and it is unlikely the tenant will commit any further breach of this kind.

The Tribunal finds that the tenant has made substantial efforts to remedy the breach of their rent obligations including, having their rent paid directly out of their benefit entitlement, engaging with a sustaining tenancies provider, and arranging payment of a substantial portion of their rent arrears.

On this occasion the Tribunal declines to terminate the tenancy or to make a conditional order. The outstanding rent arrears sum of $84.00 is awarded. Costs
