The Bond Centre is to pay the bond of $688.60 ([Bond number suppressed]) to Reliance Property Management Limited immediately. The Bond Centre is to pay the bond of $171.40 ([Bond number suppressed]) to [The tenant/s] immediately.

Reasons

Both parties attended the hearing on 26 August 2025 via teleconference. Only one of the two tenants attended.
The tenancy was from 16 April 2016 and ended on 30 June 2021.
On 10 June 2025, the landlord made an application to the Tribunal seeking for water rates arrears of $2,898.00.
This amount was for the total water rates arrears accrued during the tenancy.
The Limitation Act 2010 limits money claims to a period of six years. Therefore, the landlord is statute-barred to any claim before 10 June 2019.
The tenant initially argued that he was not a named party to the tenancy but evidence was provided by the landlord that had both tenants named as tenants. I find that both tenants were tenants to the tenancy.
The landlord explained that the delay in lodging the application was due to not being able to locate the other tenant. However, that does not resolve the legal limits as prescribed in the Limitation Act 2010.
The landlord provided a breakdown of the water rates arrears from 17 June 2019 to 11 June 2021. I disallow the $10.73 for the 17 June 2019 invoice as that invoice covers from 10 May 2019 to 12 June 2019. That goes past the limitation period.
The amount owing for water rates arrears from 15 July 2019 invoice to 11 June 2021 invoice is $661.60. I order the tenant to pay this amount to the landlord from the bond.
As the landlord has substantially succeeded with the claim, I order the tenant to reimburse the filing fee.
Finally, I do not find there is public interest in having the tenant named in the order for not having paid water rates arrears some four years after the tenancy has ended due to the landlord’s delay in lodging the application. Therefore, I suppress the name of the tenants.
