Reasons

[The landlord’s representative/s] attended the video conference hearing. The tenant’s phone number, the last three digits being 175, was called twice without any response. As the tenant was served, the hearing proceeded in the tenant’s absence.

The landlord filed an application on 2 May 2025 for termination of the tenancy, rent arrears and refund of the bond. The landlord filed a further application on12 June 2025 for termination based on notice to quit.

The landlord provided a 90-day notice to the tenant dated 13 March 2025, with the last day of the tenancy to be 11 June 2025. The landlord said the tenant failed to leave the property by this date, that the tenant has installed a deadbolt inside the door without the landlord’s consent, and so the landlord can no longer access the property, and the tenant has allowed others to live in the property without the landlord’s knowledge or consent. The landlord said they have tried multiple times to contact the tenant without success and to access the property, also without success. The landlord said the tenant remains in possession of the property as at the hearing date.

I note the termination notice complies with the requirements set out in section 51(3) Residential Tenancies Act 1986 (“RTA”) and so the termination notice is valid. As such, possession of the property must be returned to the landlord.

Further, the landlord provided copies of 14-day notices issued to the tenant about rent arrears on 4 March 2025, 11 March 2025 and on 8 May 2025, none of which were remedied by the tenant, according to the landlord. The landlord applied for termination pursuant to section 56 RTA.

Subsection 56(2) RTA provides that, where an application is made by the landlord under section 56 and the Tribunal is satisfied that at the time of determining the matter the landlord could have made an application under section 55, the Tribunal shall determine the matter as if an application had been made under that section.

At the time of determining the application, rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
