The hearing proceeded by way of telephone conference. The landlord appeared. Unsuccessful attempts were made to join the tenant to the hearing using the telephone numbers provided. The Tribunal was satisfied that the tenant was properly served with the notice of hearing and the case proceeded in their absence.

The tenancy commenced on 13 December 2022 and was periodic.

On 1 April 2025 the landlord served the tenant with a 90-day notice terminating the tenancy and requiring possession on 25 July 2025.

On 15 June 2025 the landlord filed an application with the Tribunal seeking the following: a. Termination of the tenancy for rent arrears under section 55(1)(a) of the Residential Tenancies Act 1986 (the “Act”). b. Termination of the tenancy for breach of the tenant’s obligations to pay rent under section 56(1)(a) of the Act. c. An order for rent arrears. d. Refund of the bond. e.
