Is the tenant liable for the cleaning, carpet cleaning and exterior cleanup?

Section 40(1)(e)(iii) obligates the tenant to leave the premises in a reasonably clean and reasonably tidy condition and to remove, or arrange for the removal from the premises, of all rubbish. The applicant has provided photographs showing that the property required cleaning, that there were visible stains on the carpet in several areas of the home, and that the exterior of the property was overgrown and that belongings were left behind at the conclusion of the tenancy. I am satisfied that the tenant was in breach of their obligations under this section, and I therefore award the claims of $67.50 for cleaning, $140.00 for carpet cleaning, and $322.00 for the exterior cleanup.

Is the tenant responsible for the locksmith call out?

The first of the locksmith invoices relates to a locksmith callout. The applicant says that during the tenancy, while the property management team were away at training, the respondent telephoned to advise they had locked themselves out of the laundry, that candles had been left burning inside, and that a locksmith was required. The respondent accepted at the time that they would be responsible for this cost, but failed to pay it. I accept that the tenant is liable for this charge and award the sum of $121.50.
This cost was originally acknowledged by the respondent in a mediated order. All other items under that order have since been resolved, leaving only the locksmith callout outstanding. I have therefore superseded that earlier order and included this amount in the present order, to ensure clarity for both parties and to consolidate the remaining obligations into a single enforceable order.

Is the tenant liable for the key replacements?

The remaining two locksmith charges concern the replacement of the exterior keys and the replacement of the laundry keys. I asked the applicant why these were billed separately across two invoices. They explained that, at the conclusion of the tenancy, the respondent did not return the keys and had indicated that they intended to return to the property to complete soe of the cleaning. The exterior keys were therefore replaced immediately to secure the premises. The replacement of the laundry keys was deferred in the hope that the respondent would return and provide them, but this did not occur, and a further locksmith callout was required.
Under Section 40(1)(e)(iv), the tenant is obliged to return to the landlord all keys at the end of the tenancy. I am satisfied that the tenant breached these obligations. I therefore award the remaining locksmith charges of $127.00 for the laundry keys and $145.00 for the exterior keys. Application Filing Fee:
