Did the tenants comply with their obligations at the end of the tenancy?

Tenants must return the premises in a reasonably clean and tidy state and remove their rubbish at the end of the tenancy. See section 40(1)(c) and (e)(iii) Residential Tenancies Act (RTA).
The RTA does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable, not on the subjective opinions of the landlord and tenant. There is no scientific way to determine what is reasonably clean and tidy, and the Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.
This is the landlord’s claim to prove. I can see from the photos that additional cleaning was required at the end of the tenancy to bring the unit to a reasonable condition. In particular the bathroom needed more cleaning and the floors needed a vacuum. The amount allowed seems fair to me based on the photos provided and the submissions at the hearing.
The claim for carpet cleaning is not allowed because the ingoing photos are blurry, which means I cannot see if the marks shown in the exit inspection photos were there at the start of the tenancy. There is also a note about “wear and tear marks” on the lounge carpet. This claim is dismissed. Other orders
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
The tenants’ application for suppression is not allowed because there is public interest when tenants have to pay money from the bond. See section 95A RTA. K Koller 01 August 2025
