The background to this claim is that the tenant signed up to a short fixed term agreement – from 14 May 2025 to 20 June 2025.

The landlord now makes a claim for rent arrears, compensation, payment of the bond and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

On 17 June 2025 the tenant advised the landlord by text that she was moving out and that she would leave the keys with the neighbour. On 20 June 2025 movers removed her belongings and the cleaner came on 21 June 2025.

The landlord seeks rent to 21 June 2025, and not to 25 June 2025 which she would have been entitled to, given that the fixed term ended on that day and the tenant had not given her 3 weeks’ notice of termination of her tenancy.

The rent record shows that as at 21 June 2025 the tenant owed $1,570.00 in rent and she is required to pay this amount.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

I accept the evidence which indicates that there were a number of fresh stains on the carpet which occurred during this tenancy. This included a sticky residue.

I accept that the cost of getting the carpet cleaned was $258.50 and she is required to pay this.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

I accept the evidence that during the tenancy a large whole was caused in one of the walls.

The tenant is required to pay the $350.75 that it cost to repair this damage.

I note that this amount is less than the $800.00 excess that would have been payable had the landlord claimed on their insurance for this damage. Filing fee reimbursement and suppression of name

The landlord has wholly succeeded with the claim against the tenant and so I am ordering the tenant to reimburse the filing fee to the landlord.
