The landlord attended the hearing today by telephone (with permission). The tenant did not attend.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy. The bond has already been refunded and was applied to rent arrears. Cleaning and Rubbish
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. A dining table was left behind ($92.00). The landlord’s photographs show some need for cleaning in the kitchen and bathroom ($379.50). The carpets were visibly stained and had to be cleaned ($241.50).

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. There were two missing window latches, a damaged kitchen cupboard, small holes in the walls, and a broken toilet seat shown in the exit inspection. The towel rail had come off the wall. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
