The tenant 1 and tenant 2 attended the hearing together with a Mandarin interpreter. The landlord did not attend.
On 20 May 2025, the landlord and the tenants signed a fixed-term tenancy with the start date of 17 June 2025 and an end date of 1 February 2026. The weekly rent was $880.00.
On 13 June 2025, just days before the tenancy was to begin, the landlord unilaterally cancelled the tenancy due to a dispute that occurred between the landlord and the property management company.
The landlord refunded the tenants all the money they paid upfront for the tenancy.
As a result of this abrupt cancellation, Tenant 2 had to find an alternative short- term accommodation which cost him $330.00 per week. He stayed there for 4 weeks until the tenants were able to find another property to move into together.
The tenant 1 had to rescind his termination notice and stay for a further 2 weeks at his previous tenancy before going on holiday and coming back to the tenants’ new property.
There was no information provided for the third tenant in relation to what impact the cancellation had on that tenant.
The tenant 2 had applied for compensation of $2,400.00 being $2,000.00 early termination penalty and $400.00 check-out service fee from moving out from his University of Auckland student dormitory early which was originally for a fixed term until December 2025.

Therefore, I do not award the $2,400.00 that is sought as compensation.
However, he did pay $330.00 for 4 weeks whereas he would have been paying $293.33 weekly instead if this tenancy did not get cancelled being one-third of the $880.00 weekly rent. I round up the difference to $40.00 per week and I order the landlord to compensate the tenant $160.00.
I acknowledge the emotional stress, inconvenience and the disruptions caused by the abrupt cancellation. The tenants would have had to find a new rental property under time pressure alongside their studies.
I order the landlord to pay the tenants collectively $500.00 to acknowledge the inconvenience.
Finally, as the tenants have wholly succeeded with this application, I order the landlord to reimburse the tenant’s filing fee also.
