Reasons
- This application was scheduled to be heard by video conference. None of the tenants linked to the Teams link provided to them and nor did they answer either of the calls I made to each of their phones. The hearing therefore proceeded in their absence.
- This was a fixed term tenancy that was due to end on 4 February 2026.
- The landlord made a claim to the Tenancy Tribunal for termination of the tenancy, rent arrears, reimbursement of the filing fee and reimbursement for a fire call out.
- Between the time of the application and the hearing, the owner found the premises abandoned on 20 August 2025.
- The landlord now seeks rent up to that date and reserves the right to seek further rent in a later application which I understand will also include compensation for the condition of the premises.
- I accept the rent record which shows that as at 20 August 2025, the rent arrears amount to $7,819.00. The tenants are required to pay this amount.
- Further to this, I understand that the premises had a monitored smoke alarm system which was set off by the tenants smoking inside, in breach of their tenancy agreement. On this evidence I accept that the tenants ought to reimburse the cost of the fire call out which I accept was $221.38.
- They are also required to reimburse the cost of filing this application to the landlord because the landlord was wholly successful with the claim against them. C ter Haar 09 September 2025
