[The tenant/s] must pay rent and the debt as follows: a. By 109 weekly payments of $108.00, being $88.00 for rent and $20.00 for the debt. b. A final payment of $99.00, being $88.00 for rent and $11.00 for the debt. c. Payments will be every Thursday, with the first payment on 18/09/2025 and continuing until 21/10/2027.

Payments will be allocated in the following order: rent, rent arrears, and the damage costs.

If the tenant fails to pay rent, rent arrears and damage costs within 2 working days of the due dates: a. The tenancy at Unit/Flat 201, 22 Portage Road, Otahuhu, Auckland 1062 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

The landlord attended the hearing by telephone. An attempt was made to call the tenant on the phone number on the file as well as another number provided by the landlord. The first number was not answered, and the second number went to voicemail.

The landlord has applied for termination of the tenancy, rent arrears and compensation for damage. The tenant wants to repay the debt to avoid immediate termination.

The tenant has caused damage to the door jamb when he fitted his own deadlock and drilled a hole in the door jamb. The repair cost was substantial, so the landlord sought the lesser amount of four weeks market rent 1 . The tenant had forgotten his key and needed access to the premises on six occasions which cost $42.00 each time. On one occasion the tenant lost his swipe card which cost $50.00 and on another occasion the tenant needed access to the premises and that cost $133.00.

I have awarded the costs sought by the landlord. The tenant has paid $180.00 toward this cost up until the date of hearing. That amount has been deducted from the full cost.

The tenant has been paying an extra $20.00 per week toward this debt since January 2025. Ten dollars has been applied to rent arrears and $10 to the costs above. In accordance with the order above the extra payment of $20.00 will now be applied to the rent arrears and then to the costs above.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986. 1 Section 49B(3)(a)(i) Residential Tenancies Act 1986

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Suppression

The landlord seeks suppression of the tenant’s name. The reason given was if the tenancy ends the tenant will be able to get another rental.

The Tribunal can suppress parties’ names in certain circumstances 2 including when a party has been successful with their application or where the Tribunal considers it appropriate after consideration of the interests of the parties and the public interest.

I have determined that the reason given for the suppression is not adequate for such an order. No suppression order is made.
