The applicant attended the hearing by video. The respondent did not attend. When first called, the respondent answered but then terminated the call. On the second attempt, the call went directly to voicemail. Background:
The applicant tells me that the tenancy ended in October 2024. They say they have been trying to liaise with the respondent to resolve the matter directly, but that the respondent has avoided them. This is the reason the application has come before the Tribunal one year after the conclusion of the tenancy.
In support of the application, the applicant has provided photographs showing an extensive amount of rubbish at the property, the premises not appearing reasonably clean and tidy, damage evident throughout the property, and gardens left unkempt and severely overgrown.
The applicant has made a claim of $1,840.57, being a percentage of the total costs incurred. They have provided invoices in excess of $10,000. They say that both the time taken to pursue direct resolution with the respondent and the decision to reduce the claim, are consistent with their ethos as a social housing provider.

Is the cleaning and damage repair claim the liability of the tenant?

At the conclusion of a tenancy, the tenant is required, under section 40(1)(e)(iii) of the Residential Tenancies Act, to return the premises to the landlord in a reasonably clean and tidy condition and to remove all rubbish. The photographs and evidence provided by the applicant demonstrate that the property fell well short of this standard. Although the rubbish removal costs appear high, the photographs clearly establish that an extraordinary volume of rubbish had to be removed from the vacated tenancy.
The applicant has also sought the cost of repairing holes in the doors and walls. In support, they have provided an invoice and photographs showing impact damage and holes. A tenant is liable under section 49B(1)(a) for intentional damage, and under section 49B(2) for damage caused by a careless act or omission. The distinction is that liability for careless damage is capped at the lesser of the landlord’s insurance excess or four weeks’ rent. I am satisfied that the damage was, at the very least, caused by carelessness on the part of the respondent.
Accordingly, I award the amount sought by the applicant. The filing fee and suppression:
