Reasons

The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered and to voicemail. After the first call went to voicemail, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 16 May 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The tenant had discussed her difficult circumstances with the landlord in April but then ceased to communicate with the it, despite ongoing attempts by the landlord to engage with her since. No withdrawal notice from the tenancy per section 56B(1) Residential Tenancies Act 1986 was given.
Photos taken on 8 July 2025 were provided and evidenced the premises as vacated with no obvious possessions or furnishings left apart from one mattress against one wall.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy is $8,077.14. The amount ordered is based on rent liability ceasing on 16 May 2025. That date nominated by the landlord. I am satisfied that this date is reasonable and there has been no failure to mitigate the loss of rent as at that date. This is the second application regarding this tenancy. The other, lodged first, remains to be heard and will continue to consider vacated claims, other than rent arrears. Filing fee
Because Rent Better Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
