Reasons

The landlord attended the hearing by video.
The tenant did not attend by the video link provided in the Notice of Hearing. I attempted to call the tenant on her mobile number during the hearing, but call was not connected. I am satisfied that the tenant was properly served and that it was appropriate to proceed with the hearing.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The tenancy is for a fixed term to 2 August 2025. On 26 June the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.
On 18 June, the tenant had advised the landlord that she may be moving to Australia and may need to ask for an early termination of the tenancy. The landlord was prepared to consider that if she could find new tenants before the fixed term ended. The tenant did not give any certainty around her possible moving date.
The landlord began advertising for new tenants. She attempted to contact the tenant to arrange for a new tenant to view the premises. The tenant initially replied and then stopped communicating or paying rent. The landlord went to the property on 26 June and saw that it was completely vacant. Rent was in arrears.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing to the end of the fixed term tenancy on 2 August.
In this case, I am prepared to award rent beyond the date of hearing, because the Landlord gave evidence in relation to prospective tenants, and I am satisfied the premises will be vacant until the end of the fixed term on 2 August.
As the landlord was the successful party, I have also awarded reimbursement of the Tribunal application fee.
