[The landlord/s] is granted possession of the premises at Room 1, 126 Vincent Street, Auckland Central, Auckland 1010, Floor 7 at 11:59pm today, Wednesday 30 July 2025.

The fridge and any other chattels of the tenancy must be immediately returned to Room 1.

Hengliang Wang must pay [The landlord/s] $873.00 immediately, calculated as shown in table below.

The Bond Centre is to pay the bond of $920.00 ([Bond number suppressed]) to [The landlord/s] immediately.

Reasons

The landlord attended the hearing represented by Ms Zhang.

Mr Wang the tenant did not attend and did not answer the calls made to his phone during the hearing. He had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in his absence.

The landlord has applied to end the tenancy and/or a possession order. This was a fixed term tenancy due to end on 3 July 2025. On 4 June 2025 the landlord gave Mr Wang notice pursuant to section 60A(2)(c) of the RTA. Mr Wang has however not yet vacated the premises and has also not paid his rent.

On the evidence provided, I am satisfied that vacant possession should be returned to the landlord immediately. This is for two reasons, firstly I am satisfied that the notice given to end the tenancy by the landlord was done so in accordance with the RTA. Pursuant to section 60A(2)(c) RTA a landlord is entitled to end a tenancy at the end of the fixed term, provided notice is given within the effective period 1 as it was here. The requirements of section 64(1) of the RTA are therefore satisfied.

Secondly, Mr Wang’s rent was at least 21 days in arrears on the date the application was filed and remains in excess of that amount. Pursuant to section 55(1)(a) RTA, this is a ground for termination.

Accordingly, the tenancy is terminated at the end of today. Mr Wang is required to return the room to the landlord in accordance with his obligations under the RTA which are to leave it reasonably clean and tidy and return all chattels provided for his benefit.

Mr Wang must also return the fridge that was provided with the tenancy to the room. The landlord has proven in evidence that he has placed the fridge in a communal area. Accordingly, it must be returned before he vacates.

The landlord has also applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed?

The landlord has provided rent records which prove the amount owing at the end of the tenancy.

The landlord also claims reimbursement of an invoice they incurred for $155 for removing a sofa that Mr Wang had left in the common area restricting exit. The landlord had issued Mr Wang a notice requiring him to remove the sofa within a 1 S60A(2A) the period that starts on the 90th day before the date on which the tenancy expires and ends on the 21st day before that date. specified time and advising him that if he did not, they would do so and he would be liable for the cost.

The landlord has established in evidence that Mr Wang did put the sofa in the common area in breach of the body corporate obligations and as such has tenancy obligations. They have also established that he did not remove the sofa when required by notice.

Accordingly, I am satisfied that Mr Wang should be liable for the cost sought.

Finally, because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee, and approve their application for suppression orders in their favour.
